The judge found the wholesaler did not supply the drug at all. They claimed they were selling a generic version of the drug called Nexium to treat heartburn, and they sold the drug at the supermarket to treat a chronic disease called Zollinger's disease.
The judge also said the manufacturer's products did not contain enough warnings about the drug to be effective against a warning against taking it without the advice of a doctor.
