A federal judge on Monday issued a temporary restraining order against a drugstore chain and a drug wholesaler on the Internet to prevent them from selling a popular prescription drug used to treat heartburn and other chronic illnesses.
The court ordered that the company and wholesaler will not be liable for any damages that it may have suffered because of their failure to warn consumers about the drug's risks.
The judge found the wholesaler did not supply the drug at all. They claimed they were selling a generic version of the drug called Nexium to treat heartburn, and they sold the drug at the supermarket to treat a chronic disease called Zollinger's disease.
The judge also said the manufacturer's products did not contain enough warnings about the drug to be effective against a warning against taking it without the advice of a doctor.
